PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent Nos.1 to 4 to permit the petitioners and member of Scheduled Caste Community people to celebrate and participate and perform the traditional rituals at the "Kovil Thirupani Kumbavisegam" festival in originally named as Iyyanar Temple and subsequently changed as Arulmigu Poornakaladevi, Pushkala Devi Sameda Sree Oorkavalan Swamy Thiru Kovil situated in Manlur Village, Thiruppuvanam Taluk, Sivagangai District, which is scheduled to be conducted on 20th April, 2018 or in any future date, within the time stipulated by this Court. ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] This Writ Petition has been filed by the petitioners on the ground that members of Scheduled Caste Community were not allowed to participate in the Kumbabhisegam for Iyyanar Temple, which has been re-named as 'Arulmigu Poornakaladevi, Pushkala Devi Sameda Sree Oorkavalan Swamy Thiru Kovil' situated in Manlur Village, Thiruppuvanam Taluk, Sivagangai District.

2. When the matter is taken up for hearing, the learned Special Government Pleader produced a communication sent by the Tahsildar, Thiruppuvanam, dated 24.04.2018, by which, it has been stated that including the petitioners, every member of the Village, were permitted to participate in the Kumbabhisegam held.

3. In view of the above, nothing survives for adjudication in this Writ Petition. Accordingly, this Writ Petition is closed. However, it is made clear that in all future functions, persons belonging to all Communities will have to be permitted to participate notwithstanding caste, creed or community.
