JUDGMENT

(Judgment of the Court was made by N.SATHISH KUMAR, J.) Challenging the order of the learned Single Judge dated 11.12.2024 passed in W.P(MD)No.28864 of 2024, the present writ appeal has been filed.

2. Heard the learned Additional Government Pleader for the appellants and the learned counsel for the first respondent. 2/6

3. The writ petition has been filed by the first respondent / writ petitioner stating that he was appointed as a Secondary Grade Teacher on 07.11.1997 with the qualification of B.Sc and B.Ed. The writ petitioner has undergone one month Child Psychology Training between 02.05.2003 and 31.05.2003. The authorities have approved the appointment of the writ petitioner as Secondary Grade Teacher with effect from 07.11.1997 onwards. The writ petitioner has attained the superannuation on 30.06.2024. When the pension proposals were forwarded to the 2nd respondent under the order impugned in the writ petition, the 2nd respondent has returned the same, stating that pension can be sanctioned only after excluding the period prior to the completion of Child Psychology Training. Challenging the same, the writ petition was filed.

any other purpose, the same could be counted for the purposes of pension. As against the said order, the Government has filed this appeal.

It is relevant to note that the judgment in Pallivasal Primary School's case (cited supra) has reached finality and in the said judgment, the issue was clearly held that the past service shall be calculated for the pension. Later, another Division Bench in W.A.(MD) No.1464 of 2021, vide order dated 28.07.2021 in the case of District Elementary Educational Officer, Tirunelveli and others vs. M.S.Shanthi and others has also followed the Pallivasal Primary School's case.

5. In such view of the matter, as the past service is ordered to be counted for pension, we do not find any infirmity in the order of the learned Single Judge. Hence, Writ Appeal is dismissed.
