Respondent/Complainant Prayer :- This Petition is filed Under Section 482 of Criminal Procedure Code praying to issue a direction in CC.No.171 of 2009,in the 1st Judicial Magistrate Court at Sivagangai District. The repeated clarification of judgment dates posted from 25.1.2018 till date to dispose the case by speedy disposal and pass such order. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. K.Guruchev, Advocate for the Petitioner and of Mr. R.M.Anbunithi, Additional Public Prosecutor for the respondent, this Court made the following order: By the order dated 23.01.2021, the learned Judicial MagistrateI, Sivagangai, was directed to dispose of the case in C.C.No.17 of 2009 within a period of one month from the date of receipt of a copy of the order.

2.Later, it was listed, under the caption for compliance, on 30.06.2021. There was no response from the concerned Court. So, report has been called for from the Judicial Magistrate-I, Sivagangai.

3. It has been stated that the case has been transferred from the Judicial Magistrate No-II, Sivagangai, to the Judicial Magistrate-I, Sivagangai, and it was taken on file in C.C.No.171 of 2009 and Ex.P1 to P14 was not received from the concerned Court. 4. It appears that the Judicial Magistrate-I, Sivagangai, and the Judicial Magistrate-II, Sivagangai, are located in very same premises. Letter addressed in the year 2019, was not responded sofar. So, report is called for from the Chief Judicial Magistrate, Sivagangai, and the Principal District Judge, Sivagangai, in this matter.

5. The Principal District Judge, Sivagangai, is directed to see that the records be immediately transmitted to the Judicial Magistrate-I, Sivagangai, and compliance report must be submitted before this Court, on or before 19.08.2021.

6. List the matter on 19.08.2021.
