ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence under Sections 498(A), 494, 406, 506(i), 109 IPC and Section 4 of TNPHW Act in C.C.No.278 of 2010 on the file of the learned Judicial Magistrate, Nilakottai.

2. The learned Counsel for the petitioner submits that the respondent police had filed absconding charge sheet and they did not receive summons from the court. He further submitted that the petitioner is ready to appear before the trial court on future hearings without fail.

3.The learned Government Advocate(Crl.side) submitted that charge sheet was filed in the year 2010 and since then warrant is pending against the petitioners.

4. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) appearing on behalf of the State. 5.Considering the facts and circumstances of the case and https://hcservices.ecourts.gov.in/hcservices/ considering the fact that the petitioners are parents of the second wife, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners are directed to be released on bail in event of arrest or on their appearance before the learned Judicial Magistrate, Nilakkottai, on their executing a separate bond for a sum of Rs.10,000/- (Rupees ten Thousand only) to the satisfaction of the learned Judicial Magistrate concerned and on further condition that the petitioners shall appear before the trial Court on all the dates of hearings except on those days by filing a petition under Section 317 Cr.P.C. by assigning valid reasons. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

5. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed. sd/- 30/04/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
