ORDER : The Court Made the following order :- The petitioner is arrayed as A.3 in Crime No.105 of 2014 on the file of the respondent police, for the offence punishable under Section 366(A) I.P.C. The petitioner was arrested and remanded to judicial custody on 17.03.2015. He has come forward with this petition seeking bail.

2. The case of the prosecution is that on 02.03.2014, the daughter of the defacto complainant aged about 17 years was missing and she was kidnapped by the accused.

3. The learned Counsel for the petitioner submitted that A.1 and the daughter of the defacto complainant fell in love with each other and on her own Volition she joined with the first accused and later they married and they are also having one child. It is further submitted that the accused 2 and 4 have moved an application for anticipatory bail before the Sessions Court, Kanyakumari and they were granted anticipatory bail in Cr.M.P.NO.908 of 2015, on 07.04.2015. He further submitted that the petitioner is similarly placed with that of the accused Nos.2 and 4.

4. Heard the learned Government Advocate (Crl.Side).

5. Considering the facts and circumstances, this court is inclined to grant bail to the petitioner.

6.Accordingly, the petitioner is directed to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Boothapandi, Kanyakumari District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders.
