PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the case on the file of the 1st Additional District Court, Madurai in I.D.O.P.No.274 of 2021 and transfer the same to the Principal District Court, Srivilliputhur, Virudhunagar District.

ORDER

The present transfer civil miscellaneous petition has been filed to transfer I.D.O.P.No.274 of 2021 from the file of the 1st Additional District Court, Madurai to the file of the Principal District Court, Srivilliputhur, Virudhunagar District.

2. The petitioner in her affidavit filed in support of the petition stated as follows:

"I humbly submit that the respondent herein initiated the above said matrimonial proceedings in I.D.O.P.No.274 of 2021 and it was pending before the 1st Additional District Court, Madurai and he stated false averments against me and I further submit that I depending upon my old age parents and child is in my custody and the distance between the my parents residence and the Madurai is more than 60 Kilometers and up and down its take 120 Kilometers and for I am attending the Court I spend mor than 6 hours travels."

3. Being satisfied with the reasons given in the affidavit filed in support of the petition, I am inclined to allow the present Transfer Civil Miscellaneous Petition. Thus, the present Transfer Civil Miscellaneous Petition stands allowed by transferring I.D.O.P.No.274 of 2021 from the file of the 1st Additional District Court, Madurai to the file of the Principal District Court, Srivilliputhur, Virudhunagar District.
