O R D E R

This Criminal Original Petition has been filed for a direction to the respondents to trace the court bundle as early as possible consequently speedy disposal of the complaint in C.C no 1074 of 2005 (R12 No. 11329 of 1996)pending on the file of the Learned Judicial Magistrate, Uthamapalayam.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent and perused the records.

3. When the matter is taken up for hearing on 30.04.2015, this court called for a report from the learned Judicial Magistrate, Uthamapalayam. About the steps taken to trace out the bundle. Accordingly, a report has been sent by the learned Judicial Magistrate, Uthamapalayam to this Registry dated 23.05.2015, which indicates the inability to trace out the original records, despite sufficient efforts have been made.

4. Considering the same, a direction is issued to the learned Judicial Magistrate, Uthamapalayam to proceed with the case in

C.C.No.1074 of 2015 with available records produced by the petitioner. The learned Judicial Magistrate is also directed to dispose of the case within a period of nine months from the date of receipt of a copy of this order.

5. This Criminal Original Petition is disposed of with the above direction.
