ORDER
The prayer in this writ petition is to quash the impugned order of the second respondent dated 08.03.2022 and consequently directing the respondents to grant permission for conducting the democratic procession and agitation on 30.03.2022 at Aruppukottai from Vaniya Chettiar Complex to Municipality Office.
2.Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.side) appearing on behalf of the respondents.
3.The petitioner is the District Secretary of one political party and doing social works and statutory rights of people. While being so, in Aruppukottai peoples are suffering due to encroachments, narrow roads and traffic congestion. Therefore, the petitioner continuously submitted the representations before the authorities concerned to remove the encroachment in the road. Even after receipt of the same, there was no action and as such announced a procession and an agitation of giving petition to donkey. It is intended to be held on 30.03.2022 at Aruppukottai. W.P(MD)No.4775 of 2022 impugned order dated 08.03.2022, it was rejected. Hence, this writ petition was filed to grant permission for conducting procession on 30.03.2022, but it had expired.
4.The learned counsel for the second respondent has filed a counter, wherein it stated that the place where the procession starting place and ending place at Municipal Corporation Office, whereas the starting point to Municipal Corporation is highly congested area and in between, the Aruppukottai Government Hospital, Aruppukottai Taluk Office and Police Station are situated and during 10.00 a.m to 11.00 a.m., there was peak hours, if they gathered for procession around 9.00 a.m to 10.00 a.m. there is possibility of the traffic jam surrounded by the some of the school. Hence it is very difficult for the people and the school going students to reach the school in time.
5.In view of the above, the date on which the petitioner intended to procession have expired. However, the petitioner is directed to make a fresh representation before the second respondent for the procession to be held on 26.04.2022. On receipt of the same, the second respondent is directed to consider the same and grant permission for the procession to be held on 26.04.2022 around 11.00 a.m. to 1.00 p.m.
