ORDER
This petition has been filed seeking orders to transfer the investigation of the case in Crime No.595 of 2023, dated 19.10.2023 from the file of the second respondent police to the file of the Inspector of Police, CBCID, Thanjavur/3rd respondent herein for further investigation.
2.The learned counsel appearing for the petitioner submitted that the complaint lodged by the petitioner on 19.10.2023, FIR has been registered in Crime No.595 of 2023 on the file of the Pattukottai Town Police Station. However, there is no progress in the investigation. Hence, she filed the present petition.
3. The learned counsel for the petitioner submitted that the petitioner is the defacto complainant before the second respondent. On 22.06.2023 at about 11.00 am, the second respondent along with police personnel entered into the petitioner's husband's shop and demanded for return of some jewels alleged to have been stolen and kept in the shop. Even at about 02.30 pm, on the same day, the police personnel had trespassed into the petitioner's house and conducted search. In the meanwhile, on 26.06.2024, the petitioner was informed that her husband had committed suicide by voluntarily falling before 2/5
the train and in this regard, FIR in Crime No.39 of 2023 was registered for offence under Section 174 Cr.P.C., by the Railway line Police (GRP, Trichy, Thiruvarur). Thereafter, the petitioner had approached the learned Judicial Magistrate No. I, Pattukkottai and filed a petition under Section 156 (3) of Cr.P.C., in Crl.M.P.No.3660 of 2023, seeking direction to the second respondent to register a case against the police officers, who are responsible for the death of her husband and the same was allowed on 11.12.2022. The Court has passed an order directing the police to inquire into the petition filed by the petitioner and to file a First Information report within a period of one month from the date of receipt of the copy of that order. In this regard, the first information report in Crime No. 595 of 2023 has been filed and there is no progress in the investigation and hence, this petition.
4.The learned Government Advocate (Criminal Side) appearing for the State submitted that the petitioner is trying to create an alibi as the petitioner's husband had died due to the torture of the police personnel and in this regard, investigation is still pending.
5. The first respondent is directed to monitor the investigation from time to time and the second respondent is directed to conclude the investigation as 3/5
expeditiously as possible preferably within a period of three months from the date of receipt of copy of this order. It is made clear that the second respondent will appraise the progress as to the investigation every Friday to the first respondent.
