ORDER

This Criminal Original Petition has been filed to direct the learned I Additional District Judge (PCR Court), Trichy to accept the surrender of the petitioner and consider the bail application on the same day on merits in relating to Crime No.65 of 2026 dated 13.02.2026 on the file of the respondent police.

2. Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. Due to previous enmity, on 05.02.2026, the accused persons, acting with common intention, abused and physically assaulted the complainant by pulling his hair and pushing him down. On 06.02.2026, they, along with others, formed an unlawful assembly, trespassed into the defacto complainant's house, damaged property including doors and 2/5

asbestos sheets, assaulted him by repeatedly slapping him, and criminally intimidated him by using his caste name and threatening him with dire consequences, thereby committing the alleged offences. Based on the complaint lodged by the 3rd respondent, an FIR was registered in Crime No.65 of 2026 for the offences under Sections 191, 296(b), 115(2), 351(2) of BNS, 2023 and 3(1)(r), 3(1)(s) & 3(2)(va) of SC/ST (POA) Act, 1989 on the file of the 2nd respondent police.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned I Additional District Judge (PCR Court), Trichy, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.65 of 2026 on the file of the 2nd respondent police. 3/5
