Side) For Intervenor : Mr.B.Senthilkumar PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 352 and 506(i) of I.P.C. in Crime No.114 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant are working in a same company and the petitioner is suspended from the company and he has wrongly come to the conclusion that the de-facto complainant is the cause for his suspension. Therefore he abused and threatened him.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.It is submitted by the learned Government Advocate (Crl.side) that no one sustained injuries in the alleged occurrence. 5.The learned counsel for the intervenor has vehemently oppose this application.

6. Considering the facts and circumstance of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions.

7. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Kumbakonam and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on https://hcservices.ecourts.gov.in/hcservices/

further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m. for period of two weeks. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

8. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
