ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Chapter I Section 2(14), 2(16)(a), 2(16)(b), 2(16)(c), Part III Section 9, Chapter V Section 39(1)(a), 39(1)(d), 39(3)(b), 39(3)(C), Chapter VI Section 50, 51(1) and 57 of Wild Life Protection Act, 1972, in W.L.O.R.No.01 of 2026 on the file of the respondent, seeks anticipatory bail.
2. The prosecution case is that the petitioner, along with other accused persons, was in illegal possession of 38 kg of sea cucumber. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody. Hence, he seeks bail to the petitioner. 2/5
4. The learned Additional Public Prosecutor submitted that the petitioner, along with other accused persons, was in illegal possession of 76 kg of sea cucumber. He further submitted that three previous cases are pending against the petitioner. Therefore, he opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and also considering the heinous nature of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the Criminal Original Petition is dismissed. (S S Y J) 19.02.2026 jbr 3/5
