ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 120(B) read with 420 IPC read with Sections 13(2) and 13(1)(d) of the Prevention of Corruption Act, in C.C.No.10 of 2012, on the file of the learned Special Judge, CBI Court, Madurai, seeks anticipatory bail.
2.It is submitted by the learned counsel for the petitioner that the petitioner has been arrayed as A.4 and the case was taken on file in the year 2012 and no summons was served on the petitioner and now the petitioner came to know that the case against him was split up and non bailable warrant was also issued against him by the learned Special Judge, CBI Court, Madurai.
3.The learned Special Public Prosecutor for CBI Cases submitted that due to absence of the petitioner for one hearing, non bailable warrant was issued against him and the petitioner may be directed to approach the Court for recalling the warrant. 4.Considering the fact that non bailable warrant was issued against the petitioner for his absence, there shall be a direction, directing the petitioner to surrender before the learned Special Judge, CBI Court, Madurai, and to file a petition for recalling the https://hcservices.ecourts.gov.in/hcservices/
warrant and the learned Special Judge, CBI Court, Madurai, is directed to consider the same on the same day and pass orders on merits and in accordance with law.
