Mr.K.Sanjai Gandhi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS, 2023 PRAYER :- For Anticipatory Bail in Crime No.123 of 2025 on the file of the respondentpolice. ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 25.02.2025 under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying to grant an order of pre-arrest bail.
2. The petitioner apprehends arrest at the hands of the respondent-police for the offences punishable under Section 310(4) of Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No.123 of 2025 on the file of the respondent-police.
3. The case of the prosecution is that on 18.02.2025, while the respondent-
police were on patrol duty, they received a tip-off that some individuals were sitting and talking inside the thorn bushes, armed with weapons. On reaching the spot, they found that the accused persons were in possession of lethal weapons and chili powder, and they were preparing to commit robbery against the public. Hence the case.
4. No representation on behalf of the petitioner.
5. Per contra, Mr.K.Sanjai Gandhi, learned Government Advocate (Crl.Side) appearing for the respondent-police, submits that the petitioner has not appeared before the respondent-Police and did not co-operate with the investigation. Therefore, he prays to dismiss this Criminal Original Petition.
6. Heard on both sides. This Court has perused the records including the First Information Report.
7. In view of the averments made in the First Information Report, this Court is of the view that the custodial interrogation of the petitioner is necessary to the investigation agency. Hence, this Court is not inclined to grant pre-arrest bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
