ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent Police for the offences under Sections 341, 147, 294(b), 323 and 506 (i) in Crime No.108 of 2018 and seek anticipatory bail. They have been shown as Accused Nos.1 to 4.
2.The defacto complainant in this case is an Advocate. This Court went through the First Information Report. It is seen that the first petitioner Sasikumar @ Sonai admittedly hit the defacto complainant with the wooden log and injured his jaw. The defacto complainant had suffered serious injury and he is still lying in hospital. Therefore, this Criminal Original Petition stands dismissed as far as the first petitioner is concerned. The petitioners 2, 3 and 4 shall directly deposit a sum of Rs.20,000/- before the Jurisdictional Magistrate to the credit of Crime No.108 of 2018. It is open to the defacto complainant to withdraw the said amount subject to this condition and hence Anticipatory Bail is granted to the petitioners 2, 3 and 4 only. petitioners 2, 3 and 4 are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Nilakottai and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 2, 3 and 4 shall appear before the respondent police as and when required for interrogation. The petitioners 2, 3 and 4 shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 3.The petitioners 2 ,3 and 4 shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
