ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the first respondent to issue objection/clearance report for grant of passport to the petitioner in the light of the second respondent letter dated 19.01.2026.

2.The brief facts are as follows:

The petitioner as early as the year 1993 obtained a passport (passport no.P217908) and left India to Malaysia for work as a "parotta master". In the year 2003, the petitioner renewed his passport. While so, on 31.03.2025, on arrival, when the petitioner's passport was checked by the Immigration Department at Trichy Airport, they found that the address in the passport and Aadhar was mismatched. Thereafter, it came 2/6

to know that the petitioner's employer, who without the knowledge of the petitioner, has obtained a new passport with Kanyakumari address. Hence, the petitioner surrendered his passport and applied to reissue a passport with the Ramanathapuram address. Based on which, the second respondent enquired into the matter and vide his letter dated 03.09.2025, has sought for a discreet enquiry to be conducted by the first respondent regarding the above-stated facts. The first respondent delegated the matter to the third respondent. The third respondent had conducted a detailed enquiry and submitted his report to the first respondent on 26.11.2025. On receipt of the same, the first respondent has forwarded his report dated 23.12.2025 to the second respondent. On receipt of the report dated 23.12.

2025, the second respondent once again vide his letter dated 19.01.2026 has sought an objection/clearance letter instead of a summary report from the first respondent. As of date, the first respondent has not acted upon the letter stated supra. Thereafter, the petitioner sent a representation dated 12.02.2026 through post to the first respondent. Since no action has been taken, the present petition has been filed.

3. The learned Government Advocate (Crl. Side) appearing for respondent Nos. 1 and 3 submitted that the contention of the petitioner is that his employer, without his knowledge, had obtained a new passport with a Kanyakumari address, is accepted and the petitioner is not having any intention to obtain a second Passport.

4. The submission is recorded. Since the file is pending before the first respondent and therefore, the first respondent is directed to pass orders on merits in accordance with law within a period of one week from the date of receipt of the copy of the order. While passing the order, the first respondent shall take the above facts into consideration. 5.With the above directions, this writ petition stands disposed of. No costs.
