ORDER

This petition is filed for Writ Mandamus directing the respondents 1 to 4 to take suitable action against the fifth respondent based on the petitioner's complaint, dated 28.07.2025.

2. The petitioner is a practicing Advocate and is also serving as a President of Mela Pallivasal at Thondi. The petitioner claims to be a 2/8

public spirited person. The petitioner states that the funds allocated by the Government of Tamil Nadu, for various development projects were being implemented without properly informing certain Ward Members. The petitioner further states that misleading budget accounts were being presented to the Members attending the Town Panchayat Council Meetings and that he recently came to know that the Executive Officer namely Mahalingam and the Junior Assistant namely Ravichandran, who were working at Thondi Town Panchayat, had been demanding illegal gratification for processing the applications and for performing their official duties.

The petitioner states that one Mohamed Ibrahimsha belonging to Thondi, had filed a complaint and based on his complaint, an FIR was registered against the concerned officials by the fourth respondent and they were subsequently arrested. Under the circumstances, the 9th ward Councillor of Thondi Town Panchayat, filed an application under the Right to Information Act and sought details of the expenditure details of Tondi Town Panchayath. In response, the Assistant Director, Local Government Finance Audit, Ramanathapuram, furnished a reply in Na.Ka.No.660/A1/2023, dated 20.09.2023.

of the expenditure details submitted during the Council meetings, serious discrepancies, irregularities and apparent acts of corruption in the financial records and expenditure statements came to light.

The petitioner states that a tender notification for the construction of daily market was issued and in the tender process and execution of work, various irregularities and acts of misappropriation took place. Therefore, the petitioner submitted a detailed complaint on 28.07.2025 to the respondents 3 and 4, requesting appropriate action. However, despite receipt of the said complaint, no action was taken. Therefore, the petitioner felt constrained to file the above said Writ Petition for the aforesaid relief.

The learned Additional Public Prosecutor, submitted that the petitioner's complaint, dated 28.07.2025 was forwarded to the Director of Town Panchayat, Chennai on 08.08.2025 vide petition No. 9909/2025/TP/RM, by the Deputy Superintendent of Police, Vigilance and Anti Corruption, Ramanathapuram Detachment for necessary action. The learned Additional Public Prosecutor further submitted that since 4/8

already action was initiated on the petitioner's complaint, dated 28.07.2025, sufficient time may be granted to the second respondent for further follow up action.

In view of the submissions made by the learned Additional Public Prosecutor and also considering that the complaint of the petitioner has been forwarded to the Director of Town Panchayath, Chennai, the Director of Town Panchayath, Chennai, is suo-motu impleaded as sixth respondent in this Writ Petition. Registry is directed to carryout the necessary amendment in the cause title.

In view of the above discussion, the newly impleaded sixth respondent, is directed to submit his action taken report on the petitioner's complaint, dated 28.07.2025 within a period of four weeks from the date of receipt of a copy of this order. The second respondent, based on the report submitted by the sixth respondent, shall take appropriate action within a period of four weeks thereafter. 5/8

7. With the above directions, this Writ Petition is disposed of. No costs.
