ORDER

This petition has been filed for issuance of Writ of Mandamus directing the respondent No.3 to consider and dispose of the petitioner's complaint dated 05.01.2026.

2.According to the petitioner, the accused attacked him and he was admitted to the hospital on 11.08.2025. However, he was discharged on the same day after receiving treatment. The petitioner further states that the third respondent visited the hospital and recorded his statement. Therefore, the petitioner was under the impression that an FIR had been registered. However, the respondent failed to do so. 3.The respondent now submits that the petitioner has lodged a complaint belatedly. After receiving the complaint, the respondent closed the matter stating that when the petitioner was admitted to the hospital, no complaint was registered.

4.Even though the petitioner was treated as outpatient, the assault occurred. Therefore, the respondent Police are bound to register an FIR. Accordingly, the third respondent Police is directed to conduct enquiry and take appropriate action based on the petitioner's complaint dated 05.01.2026 on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
