ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(3) of Tamil Nadu Gaming Act r/w Section 7(1) of Lottery Regulation Act, in Crime No.292 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and A1 were selling the banned lottery tickets. The Police party rounded the accused and seized some lottery tickets and Rs.620/- from their pocket. The petitioner ran away from the scene of occurrence. On complaint, case has been registered for the above said offences. 3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and prays for anticipatory bail in favour of the petitioner.
4.It is submitted by the learned Government Advocate (Crl.Side) that the petitioner along with other accused sold the lottery tickets, which was banned in Tamil Nadu. A1 was already arrested and enlarged on bail. The petitioner is having one previous case. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the serious nature of allegations made against the petitioner and also considering the fact that the petitioner has
involved in another case, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
