Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 341, 294 (b), 324, 307, 506(ii) I.P.C and Section 3 of TNPPDL Act in Crime No.228 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.The prosecution case is that on 17.03.2015, the accused have damaged wind screen of the bus with an iron pipe and also attacked the passengers.
3.It is submitted by the learned counsel for the petitioners that the petitioners are innocent and they have not committed any offence and prays for anticipatory bail in favour of the petitioners.
4. The learned Government Advocate submitted that injured had already been discharged from hospital and the accused caused damage to the tune of Rs.10,000/-. He would submit that in the earlier order, this Court has granted anticipatory bail to the co-accused in this case on condition that each of them shall deposit Rs.2,000/-. 5.Considering the facts and circumstances of the case and also considering the fact that the injured had already been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate Court No.II, Kovilpatti, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall deposit Rs.2,000/- each to the credit of Crime No.228 of 2015 before the Court. The petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
