Prayer: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents not to harass the petitioner under the guise of an enquiry. For Petitioner : Mr.A.Siva Subramanian For Respondents : Mr.A.Robinson Government Advocate (Criminal side)
ORDER
This petition has been filed seeking for a direction to the respondents not to harass the petitioner under the guise of an enquiry.
2.The main contention of Mr.A.Siva Subramanian, learned counsel for the petitioner is that the second respondent is harassing the petitioner by issuing summons after summons and also insisting him to repay the amount due to one financier, by name, Ajwanth.
3.Mr.A.Robinson, learned Government Advocate (Criminal side), who accepts notice on behalf of the respondents, on instructions, would contend that one Ponraj, who is the Power Agent of the financier Ajwanth has lodged a complaint against the present petitioner stating that the petitioner, after receiving a loan of rupees one crore, did not make good the payment and subsequently, issued a cheque and also undertook to repay the amount before presentation of the cheque.

Crl.O.P.(MD)No.4171 of 2021 4.The contention of the learned Government Advocate (Criminal Side) clearly shows that the matter in issue between the petitioner, the said Ajwanth and Ponraj seems to be purely a money transaction and therefore, the second respondent is directed to close the enquiry, which is pending on his file and also directed not to harass the present petitioner by issuing summons. 5.With the above observations, this Criminal Original Petition is disposed of.
