This writ petition has been filed for issuance of a writ of mandamus, directing the first and second respondents to issue the passport to the petitioner in application No.MD2076741665724, dated 11.07.2024.
2.The petitioner submitted an application dated 11.07.2024 to the first respondent seeking for issuance of a passport. However, on the basis of the objections raised by the petitioner's wife, the application of the petitioner has been kept pending. In this regard, the petitioner has also sent a representation dated 15.02.2025 to the respondents. Since, no action has been taken thereon, the present Writ Petition has been filed.
3. A detailed counter-affidavit has been filed on behalf of the first respondent by the learned Standing Counsel. The learned Standing Counsel appearing on behalf of the respondents submitted that if the 2/6
petitioner approaches the office of the Regional Passport Officer, Madurai, furnishing the marriage certificate/affidavit, along with a recent couple photograph and other relevant documents, the petitioner's application will be duly considered and an appropriate decision will be taken in accordance with law.
4. Heard the learned counsels on either side and carefully perused the entire materials available on record.
5. In view of the aforesaid submissions made by both parties, the petitioner is directed to approach the first respondent with the required documents within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of such documents, the first respondent shall consider the petitioner's application dated 11.07.2024 and pass appropriate orders on merits and in accordance with law, after affording due opportunity of hearing to the petitioner and the interested parties involved in the subject matter, within a period of four weeks thereafter.
