ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 323, 324, 506(i), 302, 120(b), 149 of IPC r/w Section 4 of TamilNadu Prohibition of Women Harassment Act in Crime No.

40 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that on 13.03.2015, both the defacto complainant's party and the accused's party assembled to settle the dispute and at that time, one Vellaiyan instigated the accused to attack and thereby the deceased Pandiarajan was attacked by one Pitchai S/o Vellaiyan and thereafter, Sundarapandi also attacked the deceased Pandiarajan with stick. The other accused have attacked the witnesses.

3.The learned counsel for the petitioner submitted that there are 20 accused in this case and overt act attributed against this petitioner is that she attacked the mother -in-law of the defacto complainant and caused injury. It is further submitted that the main accused have been arrested and they are in custody and the other accused have been released on bail and anticipatory bail.

4. The learned Government Advocate submitted that the first, second and eleventh accused were arrested and they are in custody. The third and fifth accused were arrested and released on bail. The accused 15, 18 and 19 were granted anticipatory bail by this Court. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the overt act attributed against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate Court, Thirumangalam, Madurai District, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
