ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-1 in Crime No.50 of 2015 on the file of the respondent police was arrested and remanded to the judicial custody by the respondent police on 26.02.2015 for the alleged offence under Section 302 I.P.C and hence seeks bail.
2. The case of the prosecution is that due to civil dispute, the petitioner/A-1 has engaged A-2 and A-3 and murdered the deceased, who is the father-in-law of the petitioner.
3. The learned counsel for the petitioner submitted that the deceased is the father-in-law of the petitioner and his wife had already filed civil suit claiming partition and in which, preliminary decree and final decree were already passed. It is further submitted that due to civil dispute, at the instigation of the brother-in-law of the petitioner, the petitioner has been falsely implicated in this case.
4. The learned Government Advocate(Crl. Side) on instructions submitted that major part of the investigation is over and the respondent is waiting for a report from Chemical Annalist to file a charge sheet in this case.
5. Considering the stage of investigation and the incarceration of the petitioner, this Court is inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a https://hcservices.ecourts.gov.in/hcservices/
like sum to the satisfaction of the learned Judicial Magistrate No.II, Sivakasi, and on further condition that the petitioner shall appear before the respondent police daily twice i.e., at 10.00 a.m and 5.00 p.m until further orders.
