PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the learned trial Court to expedite and conclude the trial of the present case C.C.No.83 of 2019 pending on the file of learned Judicial Magistrate No.II, Kovilpatti, within a stipulated time period as prescribed by this Court.

ORDER

This Criminal Original Petition has been filed, invoking Section 1/4

482 Cr.P.C., seeking orders to direct the learned trial Court to expedite and conclude the trial of the present case C.C.No.83 of 2019 pending on the file of learned Judicial Magistrate No.II, Kovilpatti, within a stipulated time period as prescribed by this Court.

2. The learned Additional Public Prosecutor would submit that because of the pendency of the Non Bailable Warrant against the first accused, the trial process could not be completed.

3. Considering the oldness of the crime, there shall be direction to the learned Judicial Magistrate No.II, Kovilpatti, to complete the trial process in C.C.No.83 of 2019 within a period of five months from the date of receipt of copy of this order. If any necessity arises, the learned Judicial Magistrate No.II, Kovilpatti, may split up the case against the person, against whom the warrant is pending.
