ORDER : The Court Made the following order :- The petitioners herein are shown as Accused Nos.3 and 4. They apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406 and 408 I.P.C., in Crime No.26 of 2018, seek anticipatory bail.

2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl.Side) appearing for the respondent.

3.It is seen that the Karur Vishya Bank suffered loss to the tune of Rs.27,00,000/-. The number of bags were pledged and loan were availed on the strength of the said bags. It was originally projected that the bags contained paddy. Subsequently, they found that 2197 bags contained only husk.

4. The learned counsel for the petitioners on instruction from the petitioners submitted that the said amount of Rs.27,00,000/- will be credited directly to the concerned Bank within a period of three months from the date of receipt of a copy of this order. 5.It is made clear that if the undertaking is breached, the anticipatory bail will automatically stands cancelled. No further extension of time will be granted.

6.Taking note of the above said facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Karaikudi and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
