ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(2)(3)

(4) of TNSC (RDCS) Order 1982 r/w. 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.183 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is working as movement clerk in Tamil Nadu Civil Supplies Corporation Godown, Kadachanenthal and his duty is after loading the PDS rice in the lorry and he has to issue bills to the quantity of the rice loaded in the lorry which is used to transport rice bags from TNCSC godown to the respective fair price shops. It is alleged that when the respondent police was conducted inspection, it was found that excess of 8 bags PDS rice were there and therefore, the Inspector of Police filed a complaint against the petitioner. 3.The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) appearing for the State submits that the petitioner is a movement clerk and he has illegally transported PDS rice to all ration shops and the investigation is still pending.

5.Considering the facts and circumstances of the case and considering the submission made by the learned Government Advocate (Crl.Side) that the petitioner is an employee of the Tamil Nadu Civil Supplies Corporation and when 8 bags of PDS rice were recovered from the accused persons, it cannot be viewed very lightly and therefore, the question of granting anticipatory bail to the petitioner does not arise.
