Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the respondents 1 to 3 that not to harass the petitioner and his family members under the guise of enquiry based on the complaint given by the fourth respondent. ORDER
It is an application seeking a direction to the respondents 1 to 3 not to harass the petitioner and his family members under the guise of enquiry.
2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents 1 to 3. In view of the limited relief sought for, this Court is of the view that notice need not be sent to the third respondent. https://hcservices.ecourts.gov.in/hcservices/
3.The learned counsel for the petitioner would submit that the second respondent police frequently called the petitioner and his family members and harassed them under the guise of enquiry in respect of a civil dispute.
4.The learned Government Advocate (Criminal Side) would submit that based on the petition filed by the fourth respondent against the petitioner herein, a petition enquiry has been conducted and closed as both the parties reported settlement. He would further submit that the respondents 1 to 3 did not cause any harassment to the petitioner.
5.Since the learned counsel for the petitioner submitted that the closure report is not yet received by the petitioner, a copy of the closure report is directly given to the learned counsel for the petitioner in the open Court.
6.In view of the above submission of the learned Government Advocate, there is no scope for further harassment. Hence, this Criminal Original Petition is closed.
