ORDER
[Order of the Court was made by The Hon'ble The ACTING CHIEF JUSTICE] Challenging the impugned sale notice dated 18.02.2023, issued by the 1st respondent, the petitioner has field this Writ Petition.
2. By consent, this Writ Petition is taken up for final disposal.
3. Learned counsel appearing for the petitioner would submit that though the petitioner is liable to pay a sum of Rs.8,74,000/-, the subsidy amount of Rs.3,22,000/- had already been credited to the account of the petitioner. Therefore, the petitioner is liable to pay only a sum of Rs.7, 65,000/-. He would further submit that the petitioner is ready to pay a sum of Rs.2 lakhs within two weeks from today and he shall pay the remaining balance amount in every month at the rate of Rs.1 lakh each. Hence, he prays for appropriate orders.
4. Learned counsel for the respondents has agreed for the aforesaid terms.
5. Recording the aforesaid submissions, this Court directs the petitioner to pay a sum of Rs.2 lakhs within a period of two weeks from today and thereafter, the petitioner shall pay the remaining balance amount in every month at the rate of Rs.1 lakh each, commencing from 20th April, 2023 and in the last month, the balance amount shall be paid. If there is any default for making payment of the aforesaid amount, the respondents bank is at liberty to proceed in accordance with law.
6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. [T.R., A.C.J.] [D.K.K., J.] 03.03.2023 NCC : Yes / No Index : Yes / No vsm
