ORDER

The present writ petition has been filed seeking a mandamus directing the respondents 2 to 4 to restore HT service connection No.069094460213 to run the crushing unit of the writ petitioner's firm situated in S.No.543/3B, Thulaiyanoor Village, Thirumayam Taluk, Pudukkottai District, based upon his representation dated 03.10.2025.

2. A perusal of the records reveal that the petitioner was running a stockyard as well as a crusher unit. Due to some allegations against the petitioner, the stockyard was placed under lock and seal. Therefore, the petitioner has approached this Court in W.P.(MD)Nos.8014 and 8015 of 2025. The said writ petition was disposed of on 25.04.2025, wherein the petitioner was directed to segregate the crushing unit from the stockyard to the satisfaction of the District Collector and once the said exercise is completed, the petitioner would be entitled to use the crushing unit.

3. Pursuant to the orders of this Court, the petitioner has segregated the crushing unit from the stockyard and he has also addressed a communication to the first respondent on 21.07.2025. However, the first respondent has not passed any orders based upon the communication of the petitioner dated 21.07.2025. In such circumstances, the present writ petition has been filed seeking a mandamus to restore the service connection to the crusher unit.

This Court has passed an order on 18.02.2026 directing the first respondent or any other officials directed by him to physically inspect S.No. 543/3B to find out whether the stockyard area has been segregated from the crushing unit and file a report and post the matter today. So far, no report has been filed.

5. The learned Counsel appearing for the petitioner submits that the stockyard area has been segregated from the crusher unit area and has also produced photographs to the said effect.

6. In view of the above said facts, the petitioner cannot be prevented from running the crushing unit. The TANGEDCO is directed to restore three phase 3/6

service connection to the crushing unit of the petitioner on payment of necessary charges. In case if it is found that the petitioner is illegally tapping the electricity service connection for the stockyard, the respondents are at liberty to proceed in accordance with law.

7. With the above said observations, this writ petition stands disposed of. No costs.
