ORDER

The forth respondent in W.P.Crl.(MD).No.915 of 2025 has filed this extension petition seeking to extend the time to comply the conditions imposed by this Court in the aforesaid writ petition. 2.The operative portion of the order made in the aforesaid writ petition is giving liberty to the respective parties to approach the competent civil Court to obtain the relief for injunction and it is also observed that in the event of inability of the respective parties to obtain an order of injunction within a period of six months, the respondent police was also further directed to provide necessary police protection to the petitioner therein to fence his property. 3.The learned counsel for the petitioner submitted that already a civil suit has been laid by him in O.S.No.72 of 2025 on the file of learned Subordinate Judge, Thirumangalam, and the suit schedule property of the said suit is the subject property comprised in S.No.70/ 9A at Kongar Pulliyankulam Village, Thirumangalam Taluk, Madurai District, which the petitioner is intending to fence.

4.The learned Additional Public Prosecutor submitted that after the disposal of the aforesaid W.P.Crl.(MD).No.915 of 2025, even before six months had elapsed, the writ petitioner in the aforesaid writ petition had already encroached upon the aforesaid property, even thereafter, the fourth respondent was not able to obtain an order of injunction. In this regard, a police complaint was also lodged by one Sugapriya, W/o.Mahalingam, who is the third respondent is the aforesaid writ petition, following which, the first information report in Crime No.58 of 2026 was registered on 20.02.2026 by the third resondent police. 5.Heard the learned counsel on either and carefully perused the materials available on record.

6.Considering the delicate situation, facts and circumstances, this Court hereby extended time to comply the order passed by the Court in W.P.Crl. (MD).No.915 of 2025 for a further period of two months from the date of receipt of a copy of this order.

7.Accordingly, this Writ Miscellaneous Petition is allowed. 04.03.2026 Rmk 3/3
