The Criminal Original Petition is filed seeking a direction to the second and third respondents police to register the case on the basis of the petitioner's complaint dated 11.10.2017. 2.Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondents.
3. The learned counsel for the petitioner would submit that the petitioner has made a complaint to the respondent to take action against the proposed accused and since no action has been taken, the petitioner has filed this Criminal Original Petition. https://hcservices.ecourts.gov.in/hcservices/ 4.It is represented by the learned Government Advocate (Crl.side) that based on the complaint given by the petitioner,
petition enquiry has been conducted and both parties were advised to approach the civil court.
5.The learned counsel for the petitioner would submit that the allegations made in the complaint discloses commission of offence and therefore, the said complaint made by the petitioner has to be enquired and registered a case as per the provisions of law. According to the learned counsel for the petitioner, closure of the complaint is contrary to law.
6. In the light of the disputed facts, the petitioner is at liberty to approach the concerned jurisdictional Magistrate to seek appropriate remedy.
7. This Criminal Original Petition is dismissed by giving above liberty.
