PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF CERTIORARIFIED MANDAMUS, calling for the records relating the impugned proceedings passed by the 4th Respondent vide his proceedings in Na.Ka.438/A2/2024 dated 04.02.2026 and quash the same as illegal and consequently to direct the Respondents to fix the Petitioners pension on the basis of his last drawn salary in the grade pay of Rs. 5400/- and accordingly disburse the retirement benefits, within the time that may be stipulated by this Court.

O R D E R

The petitioner was appointed as Assistant Teacher on 06.07.1988. Thereafter, she was promoted as Headmistress in the year 2006 and now working at Panchayat Union Middle Primary School, Thennangudi (North), Peravurani Taluk, Thanjavur District. She was conferred with selection grade on 12.06.2012. In total, she 2/7

has rendered 38 years of unblemished service and she is due to retire in the month of May 2026. While so, the Block Educational Officer, Thanjavur/the fourth respondent has issued a show cause notice, proposing to revise and restrict the petitioner's grade pay from Rs.5,400/- to Rs.4,700/-, based on a Government letter, dated 15.12.2023.

2.The learned counsel appearing for the petitioner submits that pursuant to G.O.Ms.No.234, dated 01.06.2009 she was granted with revised pay benefits with effect from 06.07.2008. Thereafter, as per the Government order in G.O.Ms.No.23, Finance Department, dated 12.01.2011 and the Government Letter, dated 08.11.2010, her selection grade scale was revised to Rs.15,600/- - Rs.39,100/- + Rs.5400 Grade pay. She has been drawing the salary for more than 15 years. At this juncture, the show cause notice issued by the fourth respondent proposing to revise the salary of the petitioner is in violation of principles of natural justice. Hence, this writ petition.

3.Mr.S.Vinodh, learned Government Advocate takes notice for the respondents 1 to 4. Mrs.Chamundi Bose, learned Standing Counsel takes notice for the fifth respondent. 4.It is reported that the order rejecting the request of this petitioner was challenged before the Principal Seat of this Court, wherein, arguments have been advanced and order has been reserved.

5. This writ petition is filed challenging the show cause notice. The Hon'ble Supreme Court in Union of India Vs Kunisetty Satyanarayana, reported in 2006 SCC Vol.II, 28, has held that the charge memo or show cause notice shall not be interfered with by the orders of the Courts except lack of jurisdiction of the authority or if any malafides are attributed.

6.In view of the above, this Court is not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. The petitioner is at liberty to offer her explanation based on the outcome of the order to be passed by the Principal Seat of this Court in the reserved matter. No costs. Consequently, connected Miscellaneous petitions are closed.
