C.M.P.(MD) No.2958 of 2026 in C.M.A.(MD)SR.No.14387 of 2026 K.MURALI SHANKAR,J.

The above petition has been filed seeking orders to condone the delay of 33 days in filing the appeal, challenging the award passed in M.C.O.P.No.147 of 2022 dated 07.08.2025 on the file of the Motor Accident Claims Tribunal / Additional District Court, Ramanathapuram.

2. The learned counsel appearing for the petitioners would submit that the third respondent remained ex-parte before the Tribunal and no liability was fixed on him and therefore, notice to the third respondent may be dispensed with and also filed a memo to that effect. The said memo is recorded.

3. Heard the learned counsel on either side.

4. Considering the reasons assigned and taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order and list it for admission in the usual course.
