Prayer in WA(MD)SR.No.16576 of 2024:- This Petition filed under Section XV of the Letters Patent Act, pleased to allow the Writ Appeal and to set aside the order dated 26.06.2023 made in WP(MD) No.10204 of 2023.
ORDER:- This Civil Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.D. Farjana Ghousia SPL GP, for the Petitioner and of Mr.D.Venkatesh ,Advocate for the respondent, this Court made the following order: 1.This petition is filed to condone the delay of 152 days in filing the above Writ Appeal.
2.Heard the learned Special Government Pleader appearing for the petitioners.
3.Mr.D.Venkatesh, learned counsel, undertakes to file vakalat for the sole respondent and he has no objection for condoning the delay. 4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, taking into consideration that the respondent has got no objection, 2/4
this Court is inclined to condone the delay of 152 days, however, on payment of costs.
5.Accordingly, this petition is allowed on payment of Rs.500/- (Rupees Five Hundred only) to the High Court Legal Services Committee attached to this Bench forthwith on receipt of a copy of this order, failing which this petition will be dismissed automatically without any further reference to this Court.
