The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 36 days in filing the appeal against the award, dated 01.09.2025 made in M.C.O.P.No.730 of 2023 on the file of the Special Sub Court, Motor Accident Claims Tribunal, Madurai.
2. Heard the learned counsel for the petitioner, learned counsel for the first respondent and also perused the records.
3.Notice sent to the second respondent returned as unclaimed. Service is sufficient.
4.The learned counsel for the first respondent would submit that they are not having objections. 5.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
