O R D E R

This Writ Petition has been filed seeking a Writ of Mandamus, directing the respondents to appoint the petitioner as a salesman in the third respondent Fair Price Shop (Ration shop) under Inter Caste Marriage quota based on the petitioner's application dated 05.11.2024 within the time limit that may be stipulated by this Court. 2.Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

3.The petitioner belongs to the Backward Community and her husband belongs to Scheduled Caste. The inter-caste marriage between the petitioner and her husband was solemnized on 27.09.2010 and the same was registered in the concerned registrar office vide registration certificate No.85 of 2010 dated 27.09.2010. The petitioner studied D.T.E.

(Diploma in Teacher Education) in the year 2012. The second respondent issued notification for the post of salesmen for the third respondent society. The petitioner submitted an application on 05.11.2024 and interview was held on 28.11.2024. The petitioner appeared and performed well. But, results are not published yet. The petitioner submitted a representation dated 25.11.2024 requesting the first respondent seeking appointment as salesmen under the priority of intercaste marriage quota. The same was forwarded to the third respondent. The third respondent did not take any action on the said representation. Aggrieved by the same, the present writ petition is filed.

4. In the counter affidavit filed by the third respondent, it is averred that the claim of the petitioner cannot be entertained without knowing the marks obtained by her in the selection process. The claim of the petitioner to appoint her fully on the criteria of inter-caste marriage quota cannot be considered. Basing on the averments made in the counter affidavit, the learned Special Government Pleader submits that results are yet to be announced and no candidates know where they stand and whether they come within the zone of consideration. The learned Special

Government Pleader submits that in the present selection process also, they got list from the employment exchange in terms of the Government Order wherein seniority list is being maintained in the employment exchange for inter-caste marriage quota.

Considering the submissions of the respective counsels and on perusal of the materials available on record, in the considered opinion of this Court, the petitioner has no right to claim priority in the present selection process of the salesmen in the third respondent society claiming priority under inter-caste marriage quota.

6. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
