Ganesan Respondent/ Appellant / Petitioner / Landlord Prayer:- This Civil Revision Petition filed under Section 25 of the Tamil Nadu Building (Lease and Rent Control Act, 1960, to set aside the fair and decreetal order dated 21/01/2022 made in R.C.A. No.2 of 2020 on the file of the learned Rent Control Appellate Authority, Subordinate Judge, Paramakudi, reversing the fair and decreetal order dated 20/08/2020 made in R.C.O.P. No. 3 of 2017 on the file of the Rent Controller, District Munsif Court, Paramakudi.
DECREE:- This Civil Revision Petition coming on for hearing on Monday the Eleventh day of April Two Thousand and Twenty two; upon perusing the petition, the order of the Lower Appellate Court and the Court of First Instance and the material papers in this petition and upon hearing the arguments of Mr. A. Arumugam, Advocate for the Petitioner and Mr. S. Ramesh, Advocate for Mr. V.
(1) That the fair and decreetal order dated 21/01/2022 made in R.C.A. No.2 of 2020 on the file of the learned Rent Control Appellate Authority, Subordinate Judge, Paramakudi, reversing the fair and decreetal order dated 20/08/2020 made in R.C.O.P. No. 3 of 2017 on the file of the Rent Controller, District Munsif Court, Paramakudi are be and hereby confirmed and the Civil Revision Petition dismissed;
(2) That the petitioner herein/ tenant is be and hereby directed to vacate and handed over the possession, within a period of three months from the date of order, till then, the tenant is directed to pay a sum of Rs.12,500/- per month, as rent, directly to the landlord; and (2a)(*)That The landlord/respondent be and hereby is directed to repay the advance amount, when the tenant handed over the possession, after deducting any arrears of rent. https://www.mhc.tn.gov.in/judis 1/2
