This Petition filed Under Section 482 of Criminal Procedure Code praying to pass on order of extension of time in the direction granted by this Honourable Court in Crl.OP(MD)No. 2617/2018 by order dated 01.03.2018.

This Petition is filed Under Section 482 of Criminal Procedure Code praying direction to consider the petition filed under section 70(2) of Cr.P.C. to recall the Non-Bailable Warrant against the petitioner in connection with C.C.No. 170/2013 pending on the file of the learned Judicial Magistrate No. I, Madurai.

ORDER:

This Criminal Miscellaneous petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Kannan, Advocate for the petitioner and of Mr.K.K.Rama Krishnan, Additional Public Prosecutor, appearing for Respondent, the Court made the following order:

This petition is filed to extend the time granted by this Court in Crl.O.P(MD).No.2617 of 2018, dated 01.03.2018.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. This Court by order dated, 01.03.2018 directed the petitioner to surrender before the learned Judicial Magistrate No.I, Madurai, within a period of two weeks from the date of https://hcservices.ecourts.gov.in/hcservices/

receipt of a copy of that order. But, the petitioner failed to appear before the concerned Magistrate within the stipulated time. The copy of the order was despatched on 20.03.2018 and the present petition is filed in time.

4. Considering the reasons assigned for extension of time, this petition is ordered. Time for complying the order passed by this Court in Crl.O.P(MD).No.2617 of 2018, dated 01.03.2018 is extended for a further period of two weeks, from the date of receipt of a copy of this order.
