Respondents/Respondents Prayer :- This Petition filed under section 482 of Cr.P.C to relax the condition imposed by this Hon ble Court in Crl.MP.No.7628/2019 in Crl.A(MD)No.428/2018 dated 28.08.2019 Prayer in CRL A(MD).No.428 of 2018 This Criminal Appeal filed under section 14 A(2) of SC/ST (POA) Act 1989 as amended by Act 1 of 2016 to set aside the order passed in Cr.M.

P No.3237 of 2018 dated 07/09/2018 by the Special Court for Exclusive Trial of cases under SC/ST (POA) Act 1989 Sivagangai and to enlarge the petitioner/accused on bail in connection with the case in Crime No.32 of 2018 on the file of the respondent police.

ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.R.Manikandan, Advocate for the Petitioner and of Thiru.RMS.Sethuraman, Counsel for the State on behalf of the respondents one and two, this Court made the following order:

This petition has been filed to relax the condition imposed by this Court in Crl.M.P(MD)No.7628 of 2019 in Crl.A(MD)No.428 of 2018, dated 29.08.2019.

2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this Court in Crl.M.P(MD)No.7628 of 2019 in Crl.A(MD)No.428 of 2018, https://hcservices.ecourts.gov.in/hcservices/

dated 29.08.2019 regularly and he prayed for relaxation of the said condition.

3.Mr.RMS.Sethuraman, the learned Standing Counsel appearing for State has strongly opposed to relax the condition. 4.Taking into consideration of the submissions made by both the learned counsel, the condition imposed by this Court in Crl.M.P(MD) No.7628 of 2019 in Crl.A(MD)No.428 of 2018, dated 29.08.2019 is modified to the effect that the petitioner shall appear before the concerned Court once in three months i.e., on the first working day of every three month at 10.30 a.m. until further orders. This petition is ordered accordingly.
