ORDER

This Criminal Original Petition has been filed to direct the learned Principal District and Sessions Judge (PCR), Trichy to consider the bail application to be filed by the petitioners on the same day of their surrender in Cr.NO.45/2026 on the file of the second respondent.

2. Considering the nature of the relief sought for, notice to the third respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioners herein. The third respondent belongs to Schedule Caste who is a ex-service man and retired from service in the year 2003. The defacto complainant has purchased a property and the petitioners herein have constructed a compound wall restricting the ingress and egress of the defacto complainant. When the same was questioned, the petitioners have abused the defacto complainant with filthy words and also mentioned his caste name. Hence the complaint in Crime No.45 of 2026 has been registered for the offences under Sections 296(b), 191(2), 126(2), 131 of BNS and Section 3(1)(g), 3(1)(r), 3(1)(s), 3(1)(a), 3(2)(va) and 3(1)(za)(A) of SC/ST Prevention of Atrocities Act, 1989.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby directs the learned Principal District and Sessions Judge (PCR), Trichy, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his 3/5

surrender before that Court in connection with Crime No.45 of 2026 on the file of the 2nd respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
