ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the District Collector, Tuticorin District, the second respondent herein, to direct the fifth respondent School Management to pay compensation by considering the petitioner's representations dated 19.01.2023 and 13.02.2023 (in person).
2. The learned counsel for the petitioner submits that the fifth respondent School failed to admit the petitioner's son in the 10th Standard after he had completed the 9th Standard.
3. During the course of hearing, this Court had already directed the authorities to conduct an enquiry and file a report regarding the circumstances under which the fifth respondent School issued the Transfer Certificate (T.C.) to the petitioner's son.
4. Pursuant thereto, the third respondent conducted an enquiry and filed a counter affidavit. In paragraph 5 of the counter affidavit, it is stated that the petitioner's son originally joined the School in June 2015 in the 6th Standard. He failed in the 9th Standard Annual Examination and subsequently, passed the supplementary examination conducted by the School in June 2019. Thereafter, it was the parents who, on their own volition, obtained the T.C. and admitted the child in another School. Thus, on perusal of the report, it is clear that it was not the fifth respondent, who refused admission to the petitioner's son in the 10th Standard; rather, the parents voluntarily obtained the T.C.
5. Having voluntarily taken the T.C., the petitioner has now approached this Court seeking compensation. This clearly amounts to an abuse of the process of law and reflects a greedy attempt to extract money from the School under the
guise of false allegations. The present Writ Petition has therefore been filed on incorrect and misleading grounds and is devoid of merit.
6. This Court is of the view that costs ought to be imposed on the petitioner for filing a false affidavit and abusing the process of this Court. Ordinarily, this Court would impose costs of Rs.10,000/- payable to each of the respondents, totalling Rs.50,000/-. However, considering the fact that a junior counsel has appeared in this matter, this Court refrains from imposing such costs and waives the same.
7. The Writ Petition stands dismissed with the above observations. No costs.
