PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No. 1 to close down the Sabari Sports and Recreation Club situated at Survey Number. 572/5C, Sithuvarpatti Moonu Road, Sithuvarpatti Post, Dindigul District, which is a disturbance to the public by considering the petitioners representations dated 24.02.2025 within the time stipulated by this Court.

ORDER

(Order of the Court was made by J.NISHA BANU, J.) The writ petition has been filed for a direction to the respondent No.1 to close down the Sabari Sports and Recreation Club situated at Survey Number. 572/5C, Sithuvarpatti Moonu Road, Sithuvarpatti Post, Dindigul District, which is a disturbance to the public by considering the petitioner's representation dated 24.02.2025 within a time stipulated by this Court.

2. The petitioner had given a representation to the respondents on 24.02.2025 to close the 5th respondent recreation club, since the club is situated near the school, bus stand and residential area, which cause great disturbance to the general public in and around the locality. However the said representation has not been considered so far and hence, the present Writ Petition has been filed.

3.The learned Government Pleader and the learned Government Advocate (Criminal Side) appearing for the respondents submitted that the representation of the petitioner would be considered by the respondents in accordance with law within a time frame. 4.In view of the above, this Court, without adverting into the merits of the matter or the claim made by the petitioner, directs the first respondent to consider the representation of the petitioner, dated 24.02.2025 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as the interested parties, if any. Such an exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. 3/5
