JUDGMENT
(Order of the Court was made by Dr.ANITA SUMANTH, J.) The writ petitioner is the appellant, and had filed the writ petition seeking a quash of order dated 11.05.2022 rejecting admission for three of his children in 8th, 5th and 2nd standard respectively in Kendriya Vidyalaya school in Madurai (school). 2/6
2. The writ petition came to be disposed on 29.11.2023. The Court noted that the admission for that academic year was complete and in any event, the request for transfer had not aligned with the norms prescribed for, and followed by the Kendriya Vidyalaya schools.
3. The applications have been rejected for want of vacancies and hence, there is no infirmity in the same. Hence, the writ petition came to be disposed, the Court noticing that if application were made for the next academic year, the same will be considered in accordance with prevailing norms.
4. We are not inclined to consider the appeal as there is really no prejudice caused to the appellant by virtue of the order under appeal. No school can be compelled to admit a student and the appellant, if he is keen on this very school, may re-visit the application process Kendriya Vidhyalaya, Madurai, again.
5. No liberty need be given to the appellant as he is always at liberty to make applications afresh, and nothing stands in his way. As far as the rejection of application for the academic year 2022-2023 is 3/6
concerned, the same is academic.

The guidelines for admissions in Kendriya Vidhyalaya, which have been placed before us, make it more than amply clear, that Kendriya Vidhyalayas are statutory institutions that accord preferential admission to wards (children and grand-children) of Central Government employees on account of the transferable nature of their jobs. This does not stand in the way of them considering applications of wards of noncentral Government employees as well, subject to other compliance with other aspects of the guidelines, as well as available vacancies.
7. As rightly pointed out by the learned counsel who appears for the school, admission is typically sought only at the level of Grade I and thereafter, admissions will be strictly on vacancy basis.

Our attention is drawn to Clause 7 in the guidelines, which states that admission of children who hold Transfer Certificate from one Kendriya Vidhyalaya school to another would be automatic, upon the parent having been transferred from the earlier station to the next. The extent of accommodation goes to such a level that the school even opens 4/6
a new section to accommodate the wards of transferred employees who fall within their preferential norms.
9. Applications, if any filed by the appellant in future, will be considered on the strength and merits of those applications and if they satisfy the applicable guidelines. We confirm the order of the writ Court and close this writ appeal. No costs.
