ORDER
This Criminal Original Petition is filed to call for the records relating to the proceedings in STC No.1138 of 2024 on the file of the Judicial Magistrate Court, Ramanathapuram and quash the same as against the petitioner.
2. The Learned counsel for the petitioner submitted to the petitioner is the sole accused in the pending trial in STC No.1138 of 2024. The case of the prosecution is that the the petitioner had created law and order problem to the public by causing obstruction and hindrance to the general public and to traffic. He has also parked his vehicle on the public pathway in a manner causing obstruction and without getting any proper permission erected Party Flags, flag posts and flex boards on the road, tied them in electric poles and across the road. In this regard a First Information Report in Crime No.230 of 2023 was registered on 30.07.2023 for the offenses under Sections 283 of IPC and Section 3 of the Tamil Nadu Open Places (Prevention of Disfigurement) Act 1959. The same culminated in laying a charge sheet in STC No.1138 2/5
of 2024 on the file of the learned Judicial Magistrate, Ramanathapuram.
3. The learned counsel for the petitioner, when the matter came up for admission, submitted that the petitioner has filed an undertaking tendering apology.
" I hereby give this solemn undertaking before this Hon'ble Court that, hereafter, for any public meeting, demonstration, protest or agitation, I shall obtain prior permission from the competent authority / concerned police strictly in accordance with law and the applicable rules.
4. I further undertake that I shall conduct any such meeting or gathering only after obtaining necessary permission and I shall ensure that the same is conducted in a peaceful orderly, and lawful manner. Without obtaining permission, I won't erect our party flags, flag posts and flex boards on the road, electric poles and across the road hereafter."
4. Recording the undertaking affidavit filed by the petitioner before this Court, the impugned charge sheet in STC No.1138 of 2024 on the file of the Judicial Magistrate Court, Ramanathapuram, is quashed.
