ORDER
The present writ petition has been filed to quash the order, dated 23.02.2025 and signed on 24.02.2025 passed by the third respondent in Na.Ka.No.03/Se-Aanai/Keelakarai-Utkottam/Rama/2025 and consequently direct the respondents to grant permission for conducting Kummi Paatu with the use of a mic set in connection with the Maha Sivarathiri Festival at Arulmigu Sri Valampuri Dharma Muneeswarar, Sri Vedappasamy, Sri Pon Uruman Temple at Utharavai, Keelakarai Taluk, Ramanathapuram District on 26.02.2025.
2. According to the petitioner, the petitioner decided to conduct a festival on 26.02.2025 and also decided to conduct Kummi Paatu. 2/5
Thereby, the petitioner sought permission from the third respondent but he refused on the ground that there will be a chance for law and order issue.
3. The learned Additional Public Prosecutor (Crl. Side) appearing for the respondents would submit there are three rival groups claiming rights over the Temple and thereby, there may be a chances for communal clash between the groups, if the Kummi Paatu is permitted. Therefore, he strongly opposed to allow this petition.
4. Today along with this petition, the rival parties have also filed petitions in W.P(MD)Nos.5254 and 5290 of 2025 for smooth worship and the same were also allowed by this Court. While so, by imposing some conditions, Kummi Paatu which is the cultural programme can be permitted. Therefore, it is for the third respondent to impose appropriate conditions for the programme of Kummi Paatu. Since Kummi Paatu is only a cultural programme, it can be permitted by imposing appropriate conditions. At the same time, the petitioner also ensure that no any caste related songs sung in the Kummi Paatu and also without any law and 3/5
order issue, the programme has to be conducted. If any law and order issue, then the third respondent can take appropriate action in accordance with law.
5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. 26.02.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR To 1.The Superintendent of Police, Ramanathapuram District.
