Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3, apprehends arrest at the hands of the respondent Police for the alleged offences punishable under Sections 294(b), 147, 148, 324, 307 of IPC in Crime No.246 of 2015 on the file of the respondent Police and hence, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) appearing for the State. 3.The case of the prosecution is that due to some dispute regarding the marriage proposal with the other community person,that on 03.05.2015 the petitioner along with other accused have attacked the de facto complainant and others and also abused with filthy language. 4.The learned counsel appearing for the petitioner has submitted that the de facto complainant has given a false complaint against the petitioner.

5.The learned Government Advocate(Crl.side), on instructions from https://hcservices.ecourts.gov.in/hcservices/ the respondent police, reported that injured has been discharged on 19.05.2015 and there is no previous case pending against the petitioner.

6.On consideration of the above mentioned facts and circumstances and situation of the present case, it is found that the present case is a fit case for grant of anticipatory bail with conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Sivakasi, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 am until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
