For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PRAYER :- To enlarge the Petitioner on bail in the event of his arrest by the respondent police in connection with Cr.No.2 of 2018 pending on the file of the Respondent Police.
ORDER : The Court made the following order :- This petition for anticipatory bail filed by the petitioner, who was working as Assistant/Circular Supervisor, Tiruchirappalli District Central Cooperative Bank limited, Chinnatharapuram Circle, Karur District, now under suspension. The respondent Police has registered a complaint given by the Managing Director/Joint Registrar, District Central Cooperative Bank Limited, Karur said to have been alleging that fake jewel loans were advanced two persons who were not members of the Society and the jewels were also not genuine but fake. The case was registered on 28.12.2018 and it is under investigation. This petitioner apprehending arrest, he seeks anticipatory bail.
2.The learned Additional Public Prosecutor appearing for the State would submit that the stole by the persons working in Andipatti Primary Agricultural Co-operative Society has come to light and based on the enquiry initiated under Section 81 of the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.4524 of 2020 Cooperative Society Act. The role of A1/Anbalagan, Secretary of the Society and A2/Chandrakala Assistant Secretary of the Society and A3/Sivasamy was working as Appraiser has come to light and complaint has been lodged against them. The respondent police has investigated the case and so far the petitioner is not unnamed in the FIR. However, in the course of the investigation, if material against the petitioner or any other persons involved in the crime comes to light appropriate action will be taken.
3.Since the petitioner has not so far found to be involved in the crime, there is no necessity to entertain in this bail petition. The investigation is still at nacent stage. Hence this criminal original petition is dismissed.
