Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Mandamus, directing the respondents to grant permission and to provide protection for conducting Sri Valli Thirumanam Drama of Arulmigu Muthumariamman Temple Madhu Eduppu Thiruvila of Pappampatti, Thirumayam Taluk, Pudukkottai District from 10.00 p.m on 21.03.2021 till 5.00 a.m on 22.03.2021 by considering the petitioner's representation dated 15.03.2021. By consent, this Writ Petition is taken for final hearing.
2. On the side of the petitioner, it is stated that the petitioner has filed a petition before the police and the election officials for granting permission to conduct Valli Thirumanam Drama at the Temple festival of Arulmigu Muthumariamman Temple Madhu Eduppu Thiruvila of Pappampatti, Thirumayam Taluk. The permission was granted for conducting festival on 21.03.2021 upto 10.00 p.m.. The temple festival will be at the night time and hence permission has to be granted for conducting the Drama from 10.00 p.m on 21.03.2021 till 5.00 a.m on 22.03.2021, the next day morning. 3.On the side of the respondents, it is stated that due to Election, no permission is granted after 10.00 p.m. https://hcservices.ecourts.gov.in/hcservices/ 1/2
WP(MD)No.6196 of 2021 4.On the side of the petitioner, it is stated that in the similar circumstances, this Court has ordered and passed similar order in W.P.(MD)No.7380 of 2019.
5.On the side of the respondents, it is stated that the order was passed when there was no declaration of election and when there was no COVID-19 pandemic situation.
6.On hearing both sides, this Court directs the petitioner to approach the respondents once again. The respondents are at liberty to decide the issue afresh in accordance with the situation prevailing in the said locality.
7.With the above directions, the Writ Petition is closed. No costs.
