ORDER

The Criminal Original Petition is filed to direct the second respondent not to harass the petitioner under the guise of the enquiry.

2.Heard the learned Counsel for the petitioner and Mr.A.Ramar, learned Additional Public Prosecutor who takes notice for the respondent 2 and 3.

3.The petitioner states that the third respondent has given a false complaint as against the petitioner, as if he had paid a sum of Rs.52,000/- and that the petitioner refused to repay the same. Even earlier, an enquiry was conducted on the basis of a complaint and the petitioner approached this Court and sought anticipatory bail in Crl.O.P(MD)No.3852 of 2017. Since, the Additional Public Prosecutor, reported that there was no petition pending against the petitioner, the said petition was closed by this Court. 4.Further, it is stated that once again, the petitioner is being called upon to attend the enquiry and summon was also issued to the petitioner on 03.11.2017. petitioner stated that the petitioner is being harassed unnecessarily.

5.The learned Additional Public Prosecutor, on instructions, submitted that the third respondent gave a complaint and the same was later closed and the third respondent himself had endorsed that he will work out his remedy in a Court of law. The learned Additional Public Prosecutor further stated that no further enquiry is contemplated and there is no question of harassment. 6.Recording the statement of the learned Additional Public Prosecutor, the criminal original petition is closed.
